Welcome to AstrokundliTalk.com ("we", "us", "our", "AstrokundliTalk"). By accessing or using our website, mobile apps, or related services (collectively, the "Service"), you ("you", "user", "customer") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

1. Definitions

Service: All features, tools, content, consultations, reports, products, and functionalities offered via AstrokundliTalk.

Free Services: Services available without payment (e.g. generic horoscopes, blog content).

Paid Services: Services that require payment (e.g. personalised readings, consultations, reports, gemstones, remedial suggestions).

User Content: Content you submit (e.g. feedback, comments, questions).

Account / Registration Data: Information you provide to register or use the Service (name, contact, birth data, etc.).

2. Eligibility & Account Registration

• You affirm that you are at least 18 years old (or of legal age in your jurisdiction) and legally capable of entering into binding contracts.
• You agree to provide true, accurate, current, and complete registration data, and to update it as needed.
• You are responsible for safeguarding your password / account credentials and any activity under your account.
• You must not share your login or permit unauthorized access.

3. Use of the Service

• You may use the Service only for lawful purposes and in accordance with these Terms.
• You must not use the Service to post or transmit anything illegal, infringing, harmful, defamatory, obscene, or otherwise objectionable.
• You must not attempt to disrupt or interfere with the Service (e.g. hacking, malware, denial-of-service, scraping).
• We reserve the right to suspend, restrict, or terminate your access for violations or misuse.

4. Paid Services, Payments & Refunds

• You agree to pay fees, charges, and taxes associated with the Paid Services, as displayed on the site at the time of purchase.
• Payment may be via credit card, UPI, net banking, wallet, or other payment gateways as offered.
• Once a consultation or service is rendered, refunds are generally not permitted (unless there is a material defect or error).
• If refunds are permitted (if stated), they may exclude transaction / payment gateway charges.
• Any offer, discount, or promotional pricing is subject to conditions and may be withdrawn at our discretion.

5. Intellectual Property & License

• All content, design, graphics, logos, trademarks, software, reports, and other materials on the Service are owned by or licensed to us, and protected by copyright, trademark and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service for your personal, non-commercial purposes, subject to these Terms.
• You may not reproduce, distribute, modify, publish, transmit, or create derivative works from our content except as expressly allowed in writing.

6. Disclaimers & No Warranties

• The Service is provided "as is", "as available", with all faults, and without warranties of any kind, whether express or implied.
• We do not guarantee:
  • accuracy, completeness, or reliability of astrological interpretations or predictions
  • results, benefits, or effects from following any astrological guidance or remedies
  • uninterrupted, secure, or error-free access
• Astrology is interpretative; predictions may vary across astrologers.
• Nothing on the Service constitutes legal, financial, medical, or professional advice—users should consult qualified professionals as needed.

7. Limitation of Liability

To the maximum extent permitted by law, we and our officers, employees, agents, affiliates, licensors are not liable for any loss, damage, claim or expense (including direct, indirect, incidental, special or consequential damages) arising from:

• your use, inability to use, or reliance on the Service
• any mistake, omission, interruption, defect, delay or failure of performance
• any content or advice obtained through the Service
• any third-party services, goods or content linked or used via our Service

If any jurisdiction does not allow the exclusion / limitation of certain liabilities, our liability to you is limited to the maximum extent permitted by law (e.g. refund of fees paid for the relevant service).

8. Indemnification

You agree to indemnify, defend and hold harmless AstrokundliTalk, its affiliates, officers, directors, employees, agents, licensors and service providers from and against all claims, liabilities, losses, damages, costs and expenses (including legal fees) arising from:

• your violation of these Terms
• your use or misuse of the Service
• your User Content
• your violation of any third-party rights
• your violation of laws or regulations

9. User Content / Feedback

• You retain ownership of your User Content. But by submitting it, you grant us a perpetual, irrevocable, royalty-free, worldwide, sublicensable license to use, modify, publish, distribute, and publicly display it.
• We may review, edit, remove or refuse to display User Content at our discretion (for violations, defamation, obscenity, etc.).
• You represent that your content does not violate any rights (copyright, privacy, defamation) of any third party.

10. Links to Third-Party Sites / Services

• The Service may contain links to third-party websites or services over which we have no control.
• We are not responsible for their content, policies, or practices. Use them at your own risk.
• Any third-party terms will apply separately.

11. Modifications / Changes

• We may modify, suspend, or discontinue (temporarily or permanently) the Service or any part, with or without notice.
• We may revise these Terms from time to time. The "Last updated" date will reflect changes.
• Your continued use after changes constitutes your acceptance of the updated Terms.
• If you disagree with material changes, you may stop using the Service.

12. Termination

• We may terminate or suspend your account or access, for any reason (including violation of Terms), at any time, without liability or prior notice.
• Upon termination, all rights granted to you cease immediately.
• Sections that by their nature survive termination (e.g. Intellectual Property, Disclaimers, Indemnification, Limitation of Liability) will still apply.

13. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India.
• Disputes shall be subject to the exclusive jurisdiction of courts in Mumbai.
• You may be required to exhaust internal dispute resolution (e.g. mediation) before filing legal proceedings.

14. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remainder of the Terms shall continue in full force and effect, with that provision modified to the minimum extent necessary to make it enforceable.
